Booking Terms

The following terms and conditions apply to all bookings with Onshore Breaks. On receiving payment of the Accommodation Fee, it is deemed the guest agrees and accepts the following:

PAYMENT TERMS
The Accommodation Fee for bookings made with Onshore Breaks are paid via Stripe online financial services or by Direct Deposit to Onshore Breaks.

  • 50% Deposit is charged at the time of booking. Bookings are not confirmed until the payment has been processed.

  • Final payments are due 14 days before the arrival date and will be charged automatically to the same Credit Card. If paying by direct debit guests will receive an email requesting final payment 14 days before the arrival date.

  • Bookings made via other booking channels (ie. Airbnb, Stayz, Booking.com, Riparide) are paid according to their Terms and Conditions.

SECURITY BOND
Onshore Breaks will take a security bond for the purposes of covering the cost of any major damage or additional cleaning required arising from any breach of this Agreement. This does not include reasonable general wear and tear.

  • A bond of $500 will be paid 1 day before arrival and released 3 days after departure

  • If there is damage to the accommodation, or additional cleaning is required, Onshore Breaks may retain the security bond beyond the 3 day period until the damage/cleaning can be properly assessed. Once this assessment is complete any balance of funds will be returned to the Guest.

  • If there is significant damage to the accommodation the Guest acknowledges that they may be liable for any further loss not limited to the amount of the security bond.

CANCELLATION POLICY
For bookings made directly with Onshore Breaks the follow will apply:

  • If you cancel your booking 30 days before arrival 100% of total amount paid will be refunded, less a $50 processing fee.

  • If you cancel your booking between 7-30 days before arrival 50% of total amount paid will be refunded, less a $50 processing fee.

  • Within 7 days of arrival, no refund and 100% of total amount paid will be forfeited to Onshore Breaks.

  • No refunds for early departures or for no shows.

  • Bookings made via other booking channels (ie. Airbnb, Stayz, Booking.com, Riparide) are subject to their Terms and Conditions.

CANCELLATIONS BY ONSHORE BREAKS
It is unlikely that that your booking will be cancelled by Onshore Breaks. Onshore Breaks acts as booking agent for the Property Owner and cannot be held responsible for any actions taken by the Property Owner (ie. the property is sold or withdrawn from holiday rental) or for any damage to the Property that renders it not suitable for rental. In the event that Onshore Breaks is required to cancel your booking:

  • We will notify the Guest at the earliest opportunity to discuss a refund or date modification.

  • Make all attempts to find suitable alternate accommodation.

  • If Onshore Breaks is unable to provide alternate accommodation a full refund of any money paid will be refunded to the Guest.

MOVING OR MODIFYING A BOOKING
Onshore Breaks appreciate that plans change and we will endeavour to modify your booking where possible.

  • Date modifications can be made up until 30 days before arrival. Guests are liable for any rate change that may apply to the new dates.

  • Date modifications 7-30 days before arrival may be subject to Onshore Breaks retaining 50% of any payments made unless Onshore Breaks is able to re-book the accommodation for the same time as your booking. Please contact Onshore Break to discuss further.

  • No date modifications within 7 days of arrival.

  • To modify a booking made via other booking channels (ie. Airbnb, Stayz, Booking.com, Riparide) the guest should contact their provider directly.

CHECK IN + CHECK OUT
Guest check in time is from 3pm on arrival date and check out is by 10am on departure date.

Any changes to these times must have prior consent of Onshore Breaks.

CLEANING
Standard cleaning is included with all bookings. We ask that Guests leave the Property largely in the condition that it was found and to follow the check out and cleaning instructions included in the Property manual provided at your accommodation. This will include information such as rubbish disposal, BBQ cleaning and returning furniture you may have moved to where it was on arrival. If there is an unreasonable mess left you may be charged an additional cleaning fee. Mid-stay cleans & a change of linen are available upon request and do incur additional fees.


NUMBER OF OCCUPANTS
All accommodation must only accommodate the number of Guests stated on your booking confirmation, including children and infants where permitted. No additional guests are permitted at your accommodation property in tents or any other mobile vehicles or on inflatable mattresses. Exceeding the stated number of guests will result in a termination of your booking. You being required to vacate the property immediately without refund and charges for the additional guests will apply.

CHILDREN
Children 2 years and over are charged at the full adult rate. Infants, less than 2 years of age, are not charged. If Guests will be staying with infants, they must notify Onshore Breaks or include them on their booking application. Onshore Breaks welcomes children at most of our properties but some have not been designed with children in mind. Guests are fully responsible for actions of any children in their group. If Guests are unsure of a property’s suitability for children, please contact Onshore Breaks for further information.

VISITORS
Visitors to your accommodation are not permitted without the written consent of Onshore Breaks. If Onshore Breaks consents to guests having visitors:

  • Guests are responsible for the behaviour and actions of their visitors whilst on the premises.

  • Visitors must not stay overnight.

NO SMOKING/VAPING
Smoking is strictly prohibited inside all Properties. If there is any evidence of smoking, or any smoke odour, an additional cleaning fee of $300 will be charged to cover cleaning of any soft furnishings, bedding, etc. A fee of $60 will be charged for the removal of any cigarette butts left anywhere at the Property including outdoor areas such as decks or gardens.

PETS
Pets are not allowed at any of our Properties without prior written consent of Onshore Breaks. If Onshore Breaks consents to a Guest bringing a pet onto the property,

  • Guests are fully responsible for the actions of their pet and will take any reasonable steps to prevent any damage to the Property.

  • Pets must not be left unattended at any time anywhere on the Property.

  • Guests must supervise their pets at all times, including on deck areas.

  • Pets are not allowed on/in any furniture, beds, baths or spas.

  • Guests are responsible for providing their pets bedding and food bowls.

NOISE
Guests are asked that they are considerate of neighbours and others near to the accommodation and not have loud music or parties that may disturb others nearby. If complaints are made about ‘excessive’ noise we may ask you to leave and treat this as a cancellation and breach of the Terms and Conditions of this Agreement and you will not receive a refund.

ACCOMMODATION USE
Our Properties are available to Guests for holiday rental purposes only.

  • Guests are not permitted to use the Property for events such as parties, large gatherings, or functions such as weddings.

  • Guests are not permitted to use the Property for commercial purposes or professional photography without written permission by Onshore Breaks.

PROPERTY CONDITION
Our Properties are the loved and valued holiday homes of our Property Owners. Guests are asked to treat them with the respect and care they would expect of their own property.

  • Furniture, bedding, kitchen equipment, utensils, artworks, and any other personal property supplied with the Property must not be removed from the Property. Guests must replace any furniture to where it was found and leave the Property in a clean, neat and tidy condition. The Property will be inspected by Onshore Breaks after the Guest’s departure.

  • Loss of any items within the Property or damage to the Property or furnishings in excess of normal wear and tear will be charged to Guest. In the event of any damage or breakages, the Guest must notify Onshore Breaks immediately.

  • Guests are not permitted to alter the wiring of any television, sound system, computer, or gaming equipment.

PROBLEMS WITH THE PROPERTY
Onshore Breaks and the Property Owner make all attempts to properly maintain the Property to good working order. Onshore Breaks cannot guarantee against problems with, but not limited to, the electrical systems, plumbing, water supply, heating, air conditioning, internet access, cable service, or appliances.

The Guest agrees to report any inoperative equipment or other maintenance problem to Onshore Breaks immediately. Onshore Breaks will make every reasonable effort to have repairs done quickly and efficiently. Guests will allow Onshore Breaks, or a person permitted by Onshore Breaks, access to the property for purposes of repair and inspection. Onshore Breaks is not responsible for any inconvenience that may occur and no refunds or rent reductions will be made due to failure of such items.

OTHER THINGS TO CONSIDER
In addition to details set out in this Agreement:

  • Bedding configuration: It is the responsibility of the Guest to be aware of the bedding configuration for the accommodation booked. Where there is an option for 2 x single beds or a king bed configuration, guests must notify Onshore Breaks with their preference 48 hours before arrival. Bed configuration cannot be changed after check in. Although guests will always have sole use of their rented accommodation, at some properties Onshore Breaks will close off bedrooms according to guest numbers, this information is included in the individual property descriptions.

  • Lost or damaged keys: A replacement fee of $350 applies for lost keys or remote devices for gates/garages. Guests must contact Onshore Breaks immediately

  • Wi-Fi: The Otway region is prone to telecommunication black spots and crowded networks during peak tourist times. Where Wi-Fi is available at the Property, Onshore Breaks and the Property Owners will take reasonable action to provide reliable, secure and stable access to the Guest Wi-Fi, but does not guarantee that it will be continuous, fault free, secure or accessible at all times. Onshore Breaks will not be liable if access to the Guest Wi-Fi becomes unstable, unsecured, slow or unavailable for any reason whatsoever. Should the Wi-Fi not be available due to technical or service issues no compensation will be given.

  • Provisions: While initial provisions are supplied, for example tea, coffee, sugar, soaps, some kitchen condiments, toilet paper etc, it is expected that guests may need to bring or purchase additional supplies depending on the length of their stay.

  • Insects: Our Properties are located in wonderful natural environments so there are plenty of insects. Guests are advised not to leave lights on at night with the doors open as this will only attract them.

  • Personal property: Onshore Breaks will not be responsible for any personal property left on or around the Property. Any items left at a Property will only be held for a period of 7 days after departure date. Any items claimed must be collected within 30 days or can be returned by post by arrangement. For the return of any personal property a retrieval fee of $40 + postage cost applies. 

LIABILITY
Onshore Breaks or the Property Owner are not responsible for any accidents, injuries or illness that occur to any Guest’s or their visitor’s visitors while at the Property.

  • Onshore Breaks or the Property Owner are not responsible for loss of personal belongings or valuables belonging to any of the Guest’s or their visitors.

  • Guests agrees to assume the risk of any harm arising from use of the Property.

  • Under no circumstances and under no legal contact or otherwise, shall Onshore Breaks or the Property Owner, be liable to Guests or Guests visitors for any damages of any nature including rising out of or relating to this Agreement or Guests rental of the Property. In no event will Onshore Breaks or the Property Owner be liable for any damages in connection with this Agreement.

INDEMNITY
Guest acknowledges that the use of the Property by the Guests, or their visitors, is entirely at their own risk. Guests will indemnify and hold harmless Onshore Breaks and the Property Owner from any and all expenses, costs, damages, actions, or liabilities whatsoever arising from, or related to, any and all loss of or damage to personal property or injury resulting from the use or occupancy of the Property or the failure by the Guest and/or any other occupants or Guest’s visitors to observe the rental rules of the Property.

BREACH
Any serious breach by the Guests of any of the terms of this Agreement, including but not limited to maximum occupancy, visitors and rental rules and restrictions, Onshore Breaks may cancel or alter the booking and Guests will not be entitled to a refund of any money paid under this Agreement.

GOVERNING LAW
This Rental Agreement is governed by the laws of Victoria and both Parties agree that any dispute, matter or other issue which arises between the Parties will be dealt with by the Courts of Victoria.

SEVERABILITY
If any provision of this Agreement is held to be invalid or unenforceable in whole or in part, the remaining provisions shall not be affected and shall continue to be valid and enforceable as though the invalid or unenforceable parts had not been included in this Agreement.

AGREEMENT
This Agreement represents the entire understanding and agreement between the Parties with respect to the subject matter of this Agreement. The person making the Booking confirms that all Guests have had the opportunity to read and understand the terms of this Agreement and they agree to be bound by this Agreement.
